Terms of Use (End User License Agreement)

The Beach Vibes ("we," "us," or "our") provides this mobile application ("App") subject to the terms and conditions set forth in this End User License Agreement ("EULA" or "Terms"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the Apple App Store or Google Play terms (as applicable).

2. Description of the App

The Beach Vibes App provides real-time beach conditions, weather, forecasts, live cams, activity recommendations, community reports, augmented reality features, and related tools to help users plan beach visits. Certain features are available only to subscribers.

3. Subscriptions and In-App Purchases

The App offers optional auto-renewable subscriptions (monthly and yearly) that provide ad-free access, full feature unlocks, priority support, and additional notifications.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
You can manage and cancel subscriptions at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing cycle.
No refunds for partial periods. You may request refunds directly through Apple or Google as per their policies.
Prices are shown in the App and may vary by region and promotions.
By subscribing, you agree to these Terms and our Privacy Policy.

Apple and Google are not responsible for the content or functionality of the App or for any issues related to subscriptions purchased through their platforms.

4. User Accounts

Some features require creating an account (via email/password, Google Sign-In, or Apple Sign-In). You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must provide accurate information and promptly update it if it changes.

5. User Conduct and Restrictions

You agree not to:

Use the App for any illegal purpose or in violation of any local, state, national, or international law.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
Interfere with or disrupt the App, servers, or networks.
Upload or transmit any harmful code, viruses, or content that is defamatory, obscene, or infringing.
Share your subscription or account credentials with others.
Use automated means to access the App without our permission.

6. Intellectual Property

All content, trademarks, logos, software, and materials in the App are owned by us or our licensors and protected by copyright and other laws. You may not copy, modify, distribute, or create derivative works without prior written permission, except as expressly allowed in these Terms.

7. Third-Party Services and Content

The App integrates third-party services (e.g., weather data providers, maps, analytics, ads, Firebase, Google Mobile Ads, live camera feeds). We are not responsible for third-party content, services, or their terms. Your use of third-party features is subject to their own terms and privacy policies.

8. Disclaimers and Warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. Beach conditions, weather, and other data are for informational purposes only and may not be accurate or complete. Always verify with official sources and use caution near water. We are not responsible for any decisions you make based on App information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Beach Vibes, its owners, affiliates, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination, your license ends and you must delete the App. Provisions that by their nature should survive (e.g., disclaimers, limitations, indemnification) will survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida. You consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App, email, or website. Continued use of the App after changes constitutes acceptance of the updated Terms.
